The judge and attorneys in the Parkland school shooting sentencing trial will be back in court Monday for the first time since lawyers for the gunman asked the judge to remove herself from the case.
Attorneys for Nikolas Cruz on Friday filed a motion to disqualify Circuit Judge Elizabeth Scherer from the case, claiming the judge had revealed her animosity toward lead defense attorney Melisa McNeil, and that it has “infected” the entire trial.
It’s unknown if the motion would come up during Monday’s hearing.
The motion cited Florida’s Judicial Code of Conduct that states a judge shall disqualify himself
